Recruitment licensing rules differ between countries. Where the recruiter’s own jurisdiction requires a licence, permit or registration for employment placement or worker supply, that document forms part of the review.
The review also covers the driver categories represented, the countries where candidates are sourced, the candidate consent procedure, the data protection process and the ability to supply accurate candidate documents. Recruiters must have a lawful basis for collecting, storing and sharing candidate information.
The General Data Protection Regulation applies directly in the Netherlands, so the recruiter acts as a controller for the candidate data it collects and must be able to identify its lawful basis.
The candidate has to know their profile is being submitted and has to have agreed. Reusing an old database silently does not meet that standard.
Drivers should be told who holds their data, why, where it is being sent and that employers may look at the profile.
Candidates also need to know the retention period, how to correct an error, how to withdraw consent where that is the basis used, and how to ask for deletion.
Use secure methods when processing passports, licences, driver cards, residence documents, medical information or other sensitive records. General guidance for smaller organisations is published by the European Data Protection Board. Platform access does not remove or reduce the recruiter's own data protection responsibilities.
